What is Sexual Harassment?
Unwelcome sexual advances, request for sexual fevers, and other verbal and physical conduct of a sexual nature. Sexual harassment is a behaviour. It is defined as unwelcome behaviour of a sexual nature.
E.g.: A man whistle at a woman when she walks by. Or a woman looks a man up and down when he walks towards her.
Sex Discrimination
Sex discrimination is a behaviour. It occures when employment decisions are based on an employees sex or when an employee is treated differently because of his/her sex.
Sexual harassment includes many things.
Actual or attempted rape or sexual assault. Unwanted pressures for sexual favours. Unwanted sexual look or gestures. Unwanted pressure for dates. Whistling at someone.
Cat calls. Sexual commits. Personal questions about social and sexual life.
Four ways of sexual harassment.
Verbal
Referring to an adult as a girl, hunk, Dall, babe, honey.
Whistling at someone, cat calls.
Making sexual comments about a person's body.
A turning work discussions to sexual topic.
Telling sexual jokes or stories.
Non-verbal
Looking a person up and down (elevator eyes). Staring at someone.
Blocking a person's path.
Following a person.
Giving personal gifts.
Making sexual gestures with hands.
Making facial expressions such as winking, throwing kisses, or licking lips.
Physical
Giving a massage around the neck or shoulders.
Touching the person's clothing, hair, or body.
Hugging, kissing, patting, stroking.
Standing close or brushing up against another person.
Touching or rubbing one self sexually around another person.
Textual/ electronic
Electronically sending messages with sexual content, including pictures and videos.
The use of sexually explicit language, harassment, cyber stalking and threats via all forms of electronic communication.
E.g. : email, text, picture, video messages, intranet/ on-line postings, blogs, instent messages and social networks websites like Facebook and Twitter.
Technique to avoid sexual harassment
Direct approach - Confront harasser tell him or her that the behaviour is not appropriate. Use common courtesy.
Indirect approach - send a letter to the Harasser stating the facts, personal feelings about the inappropriate behaviour and possible resolution.
Third party - request assistance from another person.
Chain of commands - report the behaviour to immediate supervisor or other's in chain of command.
File a formal complaint - take action to formally file a complaint.
The protection of women against sexual harassment at workplace bill
To provide protection against sexual harassment of women at work place and for the preservation and redressal of complaints of sexual harassments and formatters connected therewith or incidental thereto. It extents to the whole of India. Rectified on the 25 June, 1993.
Indian Penal Code
Section 294 - does any obscene act in any public place, or sings, recites and utters any obscene songs, ballads or words, in or near any public place.
Punishment- 3 months, or with fine, or with both.
Section 354 - force on any women, intending to outrage her modesty or knowing it likely that he will thereby outrage her modesty.
Punishment- punished with imprisonment for a term which may extend to two years, or with fine, or with both.
Section 509 - insult and annoyance.
Punishment - simple imprisonment for a term which may extend to one year, or with fine, or with both
use multiple reporting channels to report harassment, so they do not have to describe the incident to the perpetrator. Easy to understand policy with appropriate consequences and sanctions for harassment. Make clear that retaliation will not be supported against complainants.
Informing employees that harassment is prohibited;
Identifying who employees should contact to discuss harassment questions or concerns;
Assuring employees that they will not be punished for asking questions or sharing their concerns.
Conclusion
It is essential for all of us to take measures to prevent it from happening as it damages the life of the victim severely. Thus, make sure you help out those who are suffering from sexual harassment and make the perpetrator accountable.
Workplace harassment is a serious concern which requires immediate attention for better outcome. Although majority of the participants experience at least some form of harassment, they hesitate to objectively indicate the same due to fear of consequences of losing the job and facing further ramifications.
